PRIVACY STATEMENT

Grupo Finaccess, S.A.P.I. de C.V. (“Finaccess”) in adherence to the Mexican Federal Data Protection Law, Ley Federal de Protection de Datos Personales en Posesión de Particulares (herein “the Law”) as well as the stipulations and parameters included in the Bylaws of such Law (herein “the Bylaws”) herein makes available to the public the terms and conditions of its Privacy Statement for the Protection of Personal Information (herein “the Privacy Statement”).

 

The Entity Responsible for Personal Information: Grupo Finaccess, S.A.P.I. de C.V., headquartered at Homero 1500-201, Colonia Los Morales Sección Palmas, Zip Code 11540, Miguel Hidalgo, Mexico City, Mexico, is the entity responsible for all personal information made available to it through this website.

 

Collection of Personal Information: Finaccess will collect all or some of the following personal information: first name, last name, email address, and phone number.

 

Any Personal Information which can be perceived in the form of a personal image, be it through a photograph or video recording, as well as images included in official IDs, are also protected by this Privacy Statement and by all contractual Rights Protection formalities that have been subscribed by the Title Holder of the Personal Information generated by Finaccess and that are protected by the personal rights of every individual because of data protection treatment in alignment with the Objective as described in the current Privacy Statement as well as what is stipulated by the Law and its Bylaws.

 

When you visit this website, Finaccess is allowed to automatically collect the following information about your computer and your visit: the domain and server through which you obtained access to the internet, the internet address of the website from which you were linked directly to our website; the date and time on which you gained access to our website and the length of your visit to our website, as well as the sections you accessed; your Internet Protocol address (IP address) and your computer’s operating system and browser software. Although we are allowed to hire third-parties to manage these execution measures, in no case do we share information on the individual identity of any visitor. Those third-parties are obliged to observe our privacy standards and we only provide them with the totality of the information so that the collected information can be used solely for the purposes said third-party was hired for. Said information will be destroyed once it has been used for such purpose. 

 

Cookies are text files that are automatically downloaded and stored on the user’s computer hard drive when navigating a specific website. They enable the internet server to recall certain information about the user, including his or her preferences for viewing the websites on that server, the user, and password. Treatment: All the Title Holder’s personal information will be treated in adherence to these terms and conditions, which means that from this moment forward the Title Holder grants us his or her consent for such treatment.

 

Intent of the Use of Information: The main intent of the use Finaccess will make of the personal information it collects is as follows: to identify you, to establish communication with you, to contact you, and to send you any information you request from us. Secondary intents include the following: to send you information on Finaccess’ activities and promotions, and for statistical purposes. It is the responsibility of the Title Holder of the Personal Information to ensure that the information provided to Finaccess is true and complete, and to communicate to Finaccess any modifications in such information that it needs to know in order for the company to be able to comply with its obligation to maintain all information updated.

 

Confidentiality and Limitations: : Finaccess assures you that it will employ all available means of administrative, technical, and physical security measures to protect your information, ensuring at all times the strictest confidentiality and privacy in adherence to the stipulations of the Law and its Bylaws as well as the Self-Regulation Parameters established by the INAI and all other applicable regulations. In addition, Finaccess herein informs you that under no circumstances will it sell, lease, or transfer any of the Title Holder’s Personal Information, nor will it share, broadcast, or transfer it without prior consent by the Title Holder. You will be able to limit at any moment the use given to the personal information you have provided, by requesting such limitation in writing at our headquarters as detailed in the section Service, Questions, and Complaints.
 

 

Transference of Personal Information: Finaccess will be able to transfer personal information to third-parties, such as authorities or other entities, whether municipal, state or federal, when the transference is required in order to finalize any contractual or service matter being offered by Finaccess, its subsidiaries and/or related parties, as long as the Title Holder of the Personal Information has given consent either by means of this privacy statement or by any other means. Likewise, we herein inform you that such third-parties are under the same obligations and responsibilities concerning the use and stipulations of your personal information as per the terms Finaccess has established in the Privacy Statement as well as the personal information protection principles of the Law and its Bylaws. We also herein inform you that the information can be transferred if so requested by any authority for any reason, in adherence to all applicable regulations. If you do not expressly manifest your opposition to your personal information being transferred, it is understood that you have granted your consent.

ARCO Rights (Access, Rectification, Cancellation, and Opposition): The Title Holder of the Personal Information on his or her own, or through a duly authorized Legal Representative, has the right to initiate an ARCO Rights Proceeding in order to demand the correct handling of his or her Personal Information and to request the cancellation of the use of his or her information. Finaccess as the responsible company guarantees that it will handle the proceedings in adherence to the stipulations of the Law and its Bylaws. Such proceedings may be handled in writing at the headquarters address as detailed in this Privacy Statement, in section “Responsibility for Personal Information”. The ARCO Rights Proceedings needs to be initiated by the Title Holder of the Personal Information in writing at the headquarters address detailed in this statement or by email at the email address indicated in the section entitled “Service, Questions and Complaints”. The written document will be delivered to the Finaccess Legal Department, which in turn will take the necessary measures to comply with the stipulations of such request in a period of no more than 15 (fifteen) workdays.

 

Finaccess herein also informs you that when all legal avenues to which Finaccess is entitled in terms of your Personal Information have been pursued with no satisfactory solution, it has the right to initiate a proceeding before the Instituto Nacional de Transparencia, Acceso a la Información y Protección de Datos Personales (INAI), whose website is (www.ifai.gob.mx) within a period of 20 days after having received a response to your request by Finaccess or due to a lack of response as stipulated by Article 32 of the Law. Revoking Consent in the handling of information will be justifiable by request made by the Title Holder of the Personal Information or by a duly accredited notarized Legal Representative, enclosing the revocation request or by exercising his or her ARCO rights, in adherence to the terms established in this Privacy Statement and based on the stipulations of paragraph one of the Section on ARCO Rights. Finaccess will under no contractual circumstances be able to retain the personal information of the Title Holder once the information has been duly canceled by the established proceeding unless the applicable regulations establish that the information needs to be preserved. Finaccess will be able to keep the information when this is deemed necessary by applicable stipulations. Finaccess hereby commits to include his or her information in an Exclusion List to suspend all activity that could result in a nuisance act from using such information and such information shall be duly protected until the conclusion of the terms established by law and a request by the authority to proceed with the Cancellation, of which the user will be duly notified.

 

Revocation of Consent: Revoking Consent in the handling of information will be justifiable by request made by the Title Holder of the Personal Information or by a duly accredited notarized Legal Representative, enclosing the revocation request or by exercising his or her ARCO rights, as long as there is no formal contractual or service relationship, in adherence to the terms established in this Privacy Statement and based on the stipulations of paragraph one of the Section on ARCO Rights.

 

Options to Limit the Use or Disclosure of Personal Information: Finaccess offers you the possibility of making decisions as to how we can use your personal information; we offer you several ways to inform us about your decision. In case you wish to find out if there are options available to you that will enable you to limit the use or disclosure of your personal information for a specific treatment, please contact us by employing the contact information referred to in section Service, Questions and Complaints.

 

Exclusion List and Cancellation: Finaccess will under no contractual circumstances be able to retain the personal information of the Title Holder once the information has been duly canceled by the established proceeding, except for the following causes: Non-compliance with labor stipulations, presumption that a crime is being committed, applicable regulations, and a request from any authority. With respect to the latter, it will be the responsibility of Finaccess to retain such information in adherence to legal stipulations; when it refers to fiscal/accounting information, for a period of 5-10 years as established by Article 30 of the Federal Fiscal Code (Código Fiscal de la Federación) and in case of commercial information, for a period of 10 years as stipulated by Article 46 of the Mercantile Code (Código de Comercio). Once the term has expired, all information can be canceled.

 

Finaccess hereby commits to include the information in an Exclusion List to suspend all contractual and service activity that could result in a nuisance act from using such information and such information shall be duly protected until the conclusion of the terms established by law and a request by the authority to proceed with the Cancellation, of which the user will be duly notified.

 

Updating and Modifying the Privacy Statement: Finaccess reserves its right to update and modify the current Privacy Statement at any time. Any modifications to the Privacy Statement will be visibly published at the Finaccess Headquarters as detailed in the section entitled Service, Questions and Complaints and it will be published on our website www.grupofinaccess.com. If Finaccess were to perform a substantial change in the way it handles your personal information, we will communicate with you directly via email if you have expressly indicated to us in writing that you wish for us to do so. Any changes to our privacy statement will come into force in a period of 30 natural days from the date of publication of the new statement.
